حملة لمنظمة الدفاع الدولية بالتعاون مع المنظمة العالمية لمناهضه التعذيب: تعرض السيد نور حسن خان للتعذيب وسوء المعاملة اثناء احتجازه لدى الشرطة.

تلقت منظمة الدفاع الدولية نداءاً وتقريراً من المنظمة العالمية لمناهضه التعذيب، مطالبة منظمة الدفاع الدولية بالتدخل العاجل في قضية التعذيب الذي عانى منه السيد نور حسن خان على يد عدد من رجال الشرطة اثناء احتجازه في 11 ايلول / سبتمبر 2007 في مركز شرطة ناركيلدانكا الواقع في غرب البنغال، الهند.
ووفقاً للمعلومات الواردة:
* في يوم 11 ايلول / سبتمبر 2007 تعرض السيد خان البالغ من العمر الـ 20 عاماً للاعتقال التعسفي، للحصول على معلومات عن صهره الذي يُعتقد تورطه في قضية سرقة. تم احتجاز السيد خان في مركز شرطة ناركيلدانكا حيث تم تعذيبه بالصدمات الكهربائية على يد ادارة المركز.
* في 15 ايلول / سبتمبر 2007 تم الافراج عنه بكفالة وسيتم محاكمته بتهمة السرقة.
موقف ومطالب منظمة الدفاع الدولية:
يساور منظمة الدفاع الدولية والمنظمة العالمية لمناهضه التعذيب القلق ازاء المعاناة وعمليات التعذيب التي مر بها السيد خان. كما تعبر المنظمتين عن قلقهما البالغ بشأن:
* مسألة الافلات من العقاب ووجوب وضع حد لهذه الظاهرة المتفشية؛ و
* الخوف الذي يُزرع في ضحايا هذه الممارسات والتجاوزات اللانسانية والحاطة بكرامة الانسان.
فبالرغم من توقيع الهند على اتفاقية الامم المتحدة لمناهضة التعذيب وغيره من ضروب المعاملة او العقوبة القاسية او اللاانسانية او المهينة، الا انها لم تصدق عليها بعد.
وتشكل ممارسات السلطات الهندية انتهاكاً للعهد الدولي للحقوق المدنية والسياسية،التي هي طرف فيها.
المادة 7 من العهد تنص: لا يجوز اخضاع احد للتعذيب او المعاملة القاسية او اللانسانية او المهينة.
اما المادة 9.1 فتنص: لكل فرد الحق في الحرية والامان على شخصه. لا يجوز اخضاع احد للاعتقال او الاحتجاز التعسفي.
تحث المنظمة العالمية لمناهضة التعذيب ومنظمة الدفاع الدولية الحكومة الهندية والسلطات المختصة على:
* اجراء تحقيق واف ونزيه، في اقرب فرصة ممكنة، في ادعاءات التعذيب من أجل تحديد المسؤولين وتقديمهم إلى المحاكمة وتطبيق العقوبات و/ العقوبات الادارية المنصوص عليها في القانون.
* ضمان حماية الافراد بالشكل المطلوب في ولاية غرب البنغال.
بالاضافة الى ذلك فيجب على الهند كدولة عضو في مجلس حقوق الانسان التابع للأمم المتحدة ضمان الاحترام الكامل لحقوق الانسان والحريات الاساسية فى جميع انحاء البلاد وفقاً للقوانين الوطنية والالتزامات والتعهدات الدولية.

I urge you to guarantee in all circumstances the physical and psychological integrity of Mr. Nur Hasan Khan, including access to medical assistance if necessary.
I call on you to drop the charges held against him in the absence of valid legal charges that are consistent with international law and standards, or if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times.
Furthermore I urge you to order a thorough and impartial investigation into these events in order to identify all those responsible, bring them to trail and apply the penal and/or administrative sanctions as provided by law.
I call on you to guarantee that adequate compensation is awarded to the victim. I would like to remind you to ensure respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standard.
