علمت منظمة الدفاع الدولية بان الصحفي والكاتب اليمني عبدالكريم الخيواني يواجه دعوة قضائية غير شرعية.
تحث منظمة الدفاع الدولية الحكومة اليمنية على اسقاط جميع الاجراءات القضائية ضده وتوفير ضمانات محاكمة عادلة له.

وقف الصحفي والكاتب اليمني عبدالكريم الخيواني ثانية امام المحكمة الجزائية المتخصصة (محكمة أمن الدولة) في 10 نوفمبر 2007 للنظر في قضيته بناءا على التهم الموجهة ضده من قبل المدعي العام، وهي: التواصل مع "خلية صنعاء الحوثية الثانية" ونشر المقالات في صحف المعارضة
ووفقا للمعلومات الواردة من اليمن فان جلسة المحكمة كانت السابعة وكانت برئاسة القاضي محسن علوان وتم استعراض "قضية خلية صنعاء" واستمعت المحكمة الى كثير من التصريحات من 14 شخصاً من المشتبه بهم، من بينهم امرأتان. بالنسبة للاحكام الصادرة بحق المشتبه بهم فهي تتفاوت بين حكم الاعدام الى السجن لمدد تتراوح بين ثلاث الى عشر سنوات، في حين تم تبرئة البعض الاخر.
و قالت المتهمة الحادية عشرة السيدة منى الخالد بإن "أقوالها في محاضر تحقيقات النيابة غير صحيحة وإنها أدلت بها مكرهة في سجن
المباحث الجنائية." واستطردت "أن المحقيين كانوا يبحثون من خلال التحقيق معي عن إدانة ضد الخيواني."
ووفقاً للمراقبين والمتابعين فان التهم الموجهة ضد الخيواني مرتبطة ارتباطاً مباشراً بمحاولة السلطات في اليمن للانتقام من الخيواني بسبب انتقاده للسلطات وبان السلطات تبتدع تهمة ارتباطه مع خلية صنعاء الثانية للتمكن من اتهامه بالاشتراك في اعمال ارهابية.
المحطات الرئيسية في القضية:
درس الخيواني الاقتصاد والعلوم السياسية في جامعة صنعاء. وهو رئيس تحرير سابق للصحيفة الالكترونيه "الشورى".
تعرض الخيواني للمضايقات من قبل الحكومة وتم اعتقاله في نهاية عام 2004، وبقي محتجزا لمدة سنة، لحين صدور قرار اتهامه بالعديد من التهم، من ضمنها إهانة رئيس الجمهورية. توقفت صحيفة الشورى عن النشر أثناء سجنه وفقاً لنفس الحكم.
ويُعتقد بان هناك صلة بين اعتقاله وانتقاده لتوريث السلطة ولانتشار الفساد والفوضى الادارية لدى السلطات المحلية، واشارته الى اعتقالات عام 2004 الجماعية للزيديين واتباع حسين بدر الدين الحوثي من قبل وحدات معينة من قوات الامن اليمنية.
بعد الافراج عنه فى عام 2005 وفقاً لعفو رئاسي باشرت صحيفة الشورى بالنشر حتى مصادرتها مؤخراً. ولم يسمح للخيواني بالسفر الى الخارج وهو يتعرض باستمرار لاعمال التخويف بما فيها المحاكمات القضائية.
يعاني الخيواني من مرض القلب ومن تدهور في حالته الصحية والتقرير الطبي يؤكد على حاجة الخيواني للعناية المستمرة بإشراف أخصائي.
وتجري محاكمته الان بصورة مستعجلة وتحت ضغط وتنكيل نفسي يعانيه الخيواني منذ اختطافه.
تدخل منظمة الدفاع الدولية:
دشنت منظمة الدفاع الدولية عدة حملات للخيواني الذي اعتقل مرة اخرى فى 20 يونيو 2007. و دعت منظمة الدفاع الدولية بالافراج الفوري وغير المشروط عنه وضمان عدم تعرضه للتعذيب او غيره من انواع المعاملة القاسية او اللاانسانية او المهينة. وكانت الحملة ناجحة وامر قاضي المحكمة الجنائية المتخصصة في اليمن باطلاق سراحه.
وفي اغسطس 2007 تعرض الخيواني في العاصمة صنعاء للاختطاف من قبل 6 اشخاص مسلحين حيث واجه التعذيب على ايادي خاطفيه وكُسرت نظارته وهو يرتديها مما تسبب في حدوث جروح وخدوش على أنفه، وتلقى الضربات على الصدر والوجه وبالأخص عند عينه اليسرى وحدثت كسور لاضلعه وتم كسر اصبعه لكي لا يتمكن من الكتابة. وتم العثور عليه عاجزاً عن الكلام وفي حالة خطيرة مرمياً على الطريق، في منطقة دار سلم على مشارف صنعاء، بعد تلقيه للتهديدات بقتله هو واطفاله في حال قرر مواصلة الكتابة.
وفي ايلول/سبتمبر 2007 اطلقت منظمة الدفاع الدولية حملة جديدة للخيواني طالبت فيها السلطات اليمنية بـ:
* ضمان سلامة الخيواني وضمان عدم تعرضه للتعذيب او اي نوع من انواع المعاملة السيئة او العقوبة القاسية؛ وبالتالي
* ضمان عدم اختطافه مرة ثالثة ؛ و
* اعطائه فرصة الحصول على اعلى مستوى ممكن من العلاج الطبي؛ و
* العدول عن ممارسة الضغوطات والمضايقات بالاشارة الى اطفاله، اذ يتوجب عدم الخلط بين افراد الاسر فكل شخص مسؤول عن نفسه واختياراته.
وبعد استقبال السنة الجديدة فلا تزال منظمة الدفاع الدولية قلقة بشأن الاجراءات القضائية الجديدة ضد السيد الخيواني وتعتبرها نموذجاً لعزم السلطات على:
* اغلاق الصحافة المستقلة ؛ او
* اسكات كل وسائل الاعلام المستقلة؛ و
* خفض الروح المعنوية داخل الصناعة الإعلامية؛ و
* حماية مصالح الحلفاء السياسيين؛ و
* الحد من انتشار الصحفيين المحترفين على ساحة الصحافة المستقلة.
